Terms of Service

By accessing the website, submitting information, or placing an order, you agree to these Terms and any policies presented at checkout. If you do not agree, do not use the website or services.

You must use the store lawfully and provide current, complete, and accurate information. You are responsible for activity under your account and for keeping account credentials secure. Purchases by a minor must be made with the involvement of a parent or legal guardian as required by law.

Lavish Curiosity works to present product descriptions, options, images, and availability accurately. Product details may be supplied through Shopify or a manufacturing partner. If material information is incorrect, applicable consumer remedies remain available.

Prices are shown in the store and may change before an order is placed. Applicable taxes, shipping charges, customization charges, or other clearly disclosed costs are added before payment when required. A displayed error does not require Lavish Curiosity to fulfill an order at an obviously incorrect price; if that occurs, the order may be canceled and amounts paid for the affected item refunded.

An order is an offer to purchase. Lavish Curiosity may accept, decline, limit, or cancel an order for legitimate reasons, including product unavailability, suspected fraud, an incorrect price, an unsupported customization, or unlawful content. If a paid order is canceled, the affected payment will be refunded as required.

Payments are processed through Shopify and available payment providers. You authorize the amount shown at checkout and represent that you are authorized to use the selected payment method. Lavish Curiosity does not directly store complete payment-card information.

Custom and personalized products are produced specifically for the customer. Once production begins, these orders generally cannot be changed or canceled. Customers are responsible for reviewing spelling, names, numbers, sizes, colors, artwork, placement, and all other personalization before approving or submitting an order.

By submitting photographs, logos, artwork, trademarks, names, or other content, you represent that you own the content or have permission to use it for the requested product. You must not submit content that infringes another person’s copyright, trademark, privacy, publicity, or other rights.

You retain ownership of content you own. You give Lavish Curiosity and the service providers needed to complete your request a limited, nonexclusive permission to use, reproduce, adapt for production, and transmit the submitted content only as reasonably necessary to design, manufacture, deliver, support, and document your requested order.

Lavish Curiosity may decline content that appears unlawful, infringing, hateful, threatening, obscene, or otherwise inappropriate.

Original Lavish Curiosity branding, logos, graphics, website content, and original designs are protected by applicable intellectual-property laws and may not be reproduced or commercially used without authorization. Lavish Curiosity does not claim ownership of third-party trademarks or customer-owned artwork.

If Lavish Curiosity provides a proof for approval, production may begin after the customer approves it. Approval means the customer accepts the spelling, layout, personalization, placement, and design shown in the proof. Customers should carefully review names, dates, fonts, artwork, size, and colors before approval.

Approval does not waive rights relating to merchandise that is genuinely defective, damaged, incorrect compared with the approved order, or materially misrepresented.

Digital mockups and screen previews are representations. Colors may vary slightly because of screens, printing methods, garment materials, manufacturing processes, and other production factors. Minor differences in placement, scale, or color inherent to the production process are not necessarily defects. This does not limit remedies for genuinely defective, damaged, incorrect, or materially misrepresented merchandise.

Contact Lavish Curiosity promptly to request a change or cancellation. A request is not guaranteed. Ready-to-ship orders may enter fulfillment quickly, and custom orders generally cannot be changed or canceled once production begins.

Processing or production time is separate from carrier transit time. Delivery dates are estimates unless a particular service is expressly guaranteed. Additional details appear in the Shipping & Returns Policy and at checkout when available.

Eligibility depends on the item and circumstances. Standard merchandise and custom merchandise are treated differently. Review the Shipping & Returns Policy before making a return. Nothing in these Terms eliminates rights or remedies that cannot legally be waived.

The website relies on third-party services such as Shopify, payment providers, hosting, file storage, communications, manufacturers, and carriers. Their own terms and privacy practices may apply. Lavish Curiosity is not responsible for a third party’s independent conduct except to the extent required by law.

The website may occasionally be unavailable for maintenance, service interruptions, security needs, or circumstances outside reasonable control. Lavish Curiosity may modify or discontinue website features, subject to obligations for accepted orders and applicable law.

You may not use the website to violate law or another person’s rights; submit malicious code; interfere with security or operation; obtain unauthorized access; impersonate another person; commit fraud; scrape or exploit the website unlawfully; or submit prohibited custom content.

To the fullest extent permitted by applicable law, Lavish Curiosity will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the website or services. Any direct liability will be limited to the amount paid for the product or service giving rise to the claim, except where applicable law does not permit that limitation. These limits do not exclude liability that cannot legally be excluded.

To the extent legally appropriate, you agree to indemnify Lavish Curiosity from third-party claims, losses, and reasonable costs arising from your unlawful use of the services, your breach of these Terms, or content you submit that violates another person’s rights. This provision does not apply where prohibited by law or to the extent a claim results from Lavish Curiosity’s own conduct.

If any provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.

These Terms may be updated as the website, services, or applicable law changes. The date at the top identifies the latest revision. Changes apply prospectively unless otherwise stated or required by law.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where the consumer-protection laws of your location must apply.
